Terms and Conditions

As of October 1st, 2012, our company has transferred all operations to the Czech Republic.

1. Definitions

(1.1.) Welcome to Praga Medica Terms and Conditions. These Terms and Conditions apply to Your use of the Website and by accessing the Website, You agree to be bound by the Terms and Conditions set out below.
- (a) "Terms and Conditions" means these terms and conditions;
- (b) "Order placement" means all steps and actions on the Website or other means of communication between You and Praga Medica with the aim to book and order Medical Treatment and Services;
- (c) "Contract" means contract or agreement between You and Praga Medica;
- (d) “Personal Information” means the details provided by You during the Booking Process;
- (e) "Medical Appointment" means appointment for an initial examination at the Clinic in Prague arranged by Praga Medica;
- (f) "Medical Treatment" means a medical treatment or a medical procedure displayed for sale on the Website that you selected;
- (g) "Services" means additional services such airport transfers, local assistance;
- (h) "Users" means the users of the Website collectively;
- (i) "Us/Our/We/Praga Medica" means PRAGA MEDICA HEALTHCARE s.r.o., a company registered in the Czech Republic under the number 24249726 with registered office located at Na Krutci 368/5, Prague 6, Czech Republic;
- (j) "Clinic/Medical centre" means a clinic located in Prague that is contracted by Praga Medica to provide the Medical Treatment chosen by You;
- (k) "Website" means the website located at www.medicalservicesprague.com or any subsequent URL which may replace it; and
- (l) "You/Your" means a user or viewer of the Website.

A. Use of the Website

2. Introduction

(2.1.) By using or visiting any section of the Website, You agree to be bound by Our Terms and Conditions and Our Privacy Policy and You agree accordingly to the use of electronic communications in order to enter into contracts with Praga Medica; and You waive any applicable rights or requirements which require a signature by hand, to the extent permitted by any applicable law.
(2.2.) You agree on entering the site of Praga Medica to abide by our Terms and Conditions and our Privacy Policy or with any other of the applicable provisions.
(2.3.) We reserve the right to change the Terms and Conditions when necessary and Your continued use of the Website (or any part thereof) following such a change shall be deemed to be Your acceptance of such change.
(2.4.) You may use the Website for personal purposes only. Any other use without a prior written consent of Praga Medica is prohibited and will result in a breach of the terms and conditions of the Website and may lead to legal proceedings.
(2.5.) Unauthorised or illegal use of the Website may result in litigation and could constitute a criminal offence.
(2.6.) You agree not to upload any computer viruses and other code or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer.

3. Intellectual property

(3.1.) The Website contains material which is owned by or licensed to Us and is subject to intellectual property rights such as copyright, trade mark and database rights. This material includes, but is not limited to, the data, photos, design, layout, look, appearance and graphics.
(3.2.) All trade marks reproduced in the Website which are not the property of, or licensed to, the operator are acknowledged on the Website.

4. Limited liability

(4.1.) Your use of any information or materials on the Website is entirely at Your own risk, for which We shall not be liable. It shall be Your own responsibility to ensure that any products, services or information available through the Website meet Your specific requirements.
(4.2.) Neither We nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and We expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
(4.3.) In no event will We be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Website or any other website which is linked from the Website.
(4.4.) Through the Website You are able to link to other websites which are not under the control of Praga Medica. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
(4.5.) Every effort is made to keep the Website up and running smoothly. However, We take no responsibility for, and will not be liable for, the Website being temporarily unavailable due to technical issues beyond our control.
(4.6.) We reserve the right to modify, temporarily or permanently, the Website (or any part thereof) and You confirm that We shall not be liable to You or any third party for such modification of the Website.
(4.7.) You agree to fully indemnify, defend and hold Us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms and Conditions by You, or any other liabilities arising out of Your use of this Website or any other person accessing the Website using Your personal information.

B. Ordering process

5. General

(5.1.) We offer the means of placing an order of Your required Medical Treatment and Services by email or online by using our Website.
(5.2.) You are entirely responsible for the information that you provide to Praga Medica and we shall not be liable for any incorrect entries made by You, including data input errors.
(5.3.) We use PayPal as our payment gateway. Payment can be made by any major credit or debit card accepted by PayPal or by a bank transfer to Our bank account. You confirm that the credit card or debit card that is being used is Yours.

6. Services

(6.1.) Praga Medica provide the following Services:
- (a) Transfers – by ordering this service, You will be entitled to receive one Airport to Hotel and one Hotel to Airport transfer. Praga Medica’s representative will meet You at the airport or any other agreed location and transfer You to your hotel or private accommodation unless agreed otherwise;
- (b) Accommodation reservations are arranged for free when booking the above mentioned Transfer service;
- (c) 24/7 Assistance – by ordering this service, You will be entitled to receive 24hour seven days a week assistance provided by Our local representatives.
- (d) Mobile Phone Rental comes for free with ordering of the above mentioned 24/7 Assistance. You will be given for use a mobile phone with a Czech sim-card and a credit to the sum of one hundred Czech crowns for the duration of your stay in the Czech Republic. You are obliged to return the mobile phone and the sim-card to Praga Medica upon Your departure from the Czech Republic.
(6.2.) The Services will be provided to You upon your request. The total price for the Services will be added to the deposit.

7. Payment

(7.1.) The deposit is to be paid to Praga Medica. The payment of the deposit is a condition to the completion of the contract.
(7.2.) The deposit consists of an advanced payment for the Medical Treatment, a payment for the requested Services and a payment for the initial examination (where charged extra). The deposit is non-refundable unless stipulated otherwise in Terms and Conditions.
(7.3.) The payment for the Medical Treatment is to be paid to the Clinic before the procedure unless agreed otherwise. The advance payment for the Medical Treatment will be deducted from the total cost of the Medical Treatment.
(7.4.) The payment for the accommodation is to be paid upon Your arrival to the hotel unless agreed otherwise.

8. Order placement

(8.1.) You are deemed to place an order for the selected Medical Treatment and Services by pressing the CONFIRM button at the end of the online ordering process or by expressly stating your intention to do so in an email reply to Us.
(8.2.) You will receive an order acknowledgement detailing all information about Your order once You have placed the order. You accept that order acknowledgement is not an order confirmation or order acceptance from Us and does not amount to the creation of a contract between You and Us.

C. Contract

9. Creation

(9.1.) Once We receive Your payment, We will send to You an order acceptance email with all relevant information about Your order.
(9.2.) The completion of the contract between You and Praga Medica will take place upon the despatch of Our order acceptance email.
(9.3.) The Contract shall be governed by and construed in accordance with the law of the Czech Republic. The Courts of the Czech Republic shall have jurisdiction to hear and determine any actions or proceedings that may arise out of or in connection with this Contract.

10. Rights and obligations

(10.1.) You are entitled to cancel the Contract no less than 7 working days before the date of Your Medical Appointment. You are required to send a written notice to Us if you wish to cancel the Contract.
(10.2.) It is Your responsibility to arrive for the Medical Appointment on time. Neither Praga Medica nor the Clinic will be held responsible for your late arrival resulting in cancellation of the Medical Appointment.
(10.3.) You are required to cooperate with Praga Medica and respond in timely manner.
(10.4.) It is your responsibility to settle any and all costs incurred at the Clinic. You acknowledge that Praga Medica will not be held liable for any and all disputes between you and the Clinic.
(10.5.) You acknowledge that any contract between You and the Clinic shall be governed by and construed in accordance with the law of the Czech Republic. The Courts of the Czech Republic shall have jurisdiction to hear and determine any actions or proceedings that may arise out of or in connection with that contract.

11. Refund

(11.2.) You are entitled to be fully refunded for the Services booked and paid to Us, should Praga Medica fail to arrange the Medical Appointment. As a consequence, Your travel and accommodation expenses directly related to the arrangement of the Medical Appointment will also be fully refunded.

12. Cancellation of booked accommodation / No Show

(12.1.) Cancellation policy applies to the accommodation booking as follows:
- 4 days prior to arrival - 100%
- 3-1 days prior to arrival - up 50% of total price
- Less than 1 day or no-show - up 100% of total price

13. Liability

(13.1.) Our representatives answer Your questions to the best of their knowledge but the information provided can not be treated as medical advice.
(13.2.) You will be asked to sign a contract at the Clinic which will stipulate all rights and obligations related to the Medical treatment between You and the Clinic. Please note that Praga Medica will not be a party of above mentioned contract and any costs/losses arising from the performance or non performance of the Medical treatment or any services provided at the Clinic shall be sole responsibility of the signing parties of the above mentioned contract. We promise to provide all support and assistance necessary in relation to any issue that may arise between You and the Clinic.
(13.3.) It is Your sole responsibility to settle any and all costs incurred at the Clinic.
(13.4.) In the event that the medical examination at the Clinic indicates that You cannot be treated for medical reasons, neither We nor the Clinic is responsible for any of Your costs.
(13.5.) In the event there are additional costs due to unforeseen complications these costs will be Your extra expenses and You will be responsible for settling these with the Clinic.

14. Miscellaneous

(14.1.) If any one or more provisions of this document are found to be illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

15. Applicable law and jurisdiction

(15.1.) Your use of the Website and any dispute arising out of such use of the Website is subject to the laws of the Czech Republic.
